COMPA Urges Governor
Cuomo to Sign OMIG Bill
The Office of the Medicaid Inspector General (OMIG) was established to root out fraud and encourage appropriate accountability in the Medicaid program. In practice, however, the OMIG has often strayed far from that mission. They have often pursued enormous Medicaid recoveries in a heavy-handed manner, even when it is clear that there was no intent to defraud the Medicaid program. These recoveries, and the cost of legal defense against such recoveries, have had the effect of removing millions of dollars from the substance abuse treatment system in New York State. In an attempt to modify some of the more extreme and punitive auditing practices of the OMIG, Assemblyman Richard Gottfried and Senator Elizabeth Little introduced important legislation which passed in both houses of the legislature.
